Terms and Conditions of Use

Welcome to the Global Workplace Information Platform ("Information Platform"). The Information Platform is provided by Royal & Sun Alliance Insurance Ltd ("RSA", "us" or "we") to facilitate the provision of insurance programmes to multinational clients by RSA’s Global Network (the "Global Network").


ACCESS TO THE INFORMATION PLATFORM

Access to the Information Platform is restricted to those participants of the Global Network who have been provided with usernames and passwords. Any other access is strictly prohibited.

The Information Platform relies in part upon systems and networks which we do not control (including the Internet) and is, therefore, dependent upon factors outside our control. Accordingly, we make no representation and give no warranty, express or implied:

  1. as to the availability, timeliness, completeness, or performance of the Information Platform or its contents;
  2. that access to the Information Platform will be free from infection by viruses; or
  3. that access to the Information Platform and participation in any transaction facilitated by the Information Platform will be secure, uninterrupted, free of errors or free of downtime, outages or technical problems that may hinder the efficacy of participation in the Information Platform (including transmission failures or delays).


We reserve the right in our sole discretion to deny users access to the Information Platform or any part of it without notice and to decline to provide access to any user who is in breach of these Terms and Conditions of Use.


PASSWORDS AND SECURITY

By agreeing to these Terms and Conditions of Use, you agree not to do anything to prejudice the security of the Information Platform or any information residing on it and only to use that information for the purposes of the Global Network. You agree not to attempt to access any information on the Information Platform that has been denied to you and to notify RSA if you are able to access any information that you know or suspect should not be available to you. You further agree to maintain the security and confidentiality of your user ID and password and, in particular, not to allow any other person to use your user ID or password and not to commit your password to writing in any way.


DATA PROTECTION

Data protection laws in various countries worldwide protect the rights of living individuals about whom information is held or used. This information is known as "personal data".

To ensure compliance with these laws we require users of the Information Platform to follow sound and proper practices known as Data Protection Principles when obtaining, holding and using personal data. These Data Protection Principles require you:

  1. to obtain and use personal data fairly and lawfully;
  2. to obtain and use personal data only for lawful purposes notified to the person whose data is concerned;
  3. to hold sufficient personal data relevant for those purposes but no more;
  4. to keep the personal data accurate and up to date;
  5. not to keep personal data for longer than is necessary for the relevant purposes;
  6. to use personal data in accordance with the legal rights of the people it concerns (including their right to access it);
  7. to take appropriate security measures to protect personal data against unauthorised or unlawful use, accidental loss, destruction or damage; and
  8. not to transfer personal data to a country that does not ensure an adequate level of protection for the use and storage of that data.

All users of the Information Platform share the responsibility of safeguarding the personal data on it and using that personal data only in accordance with the Data Protection Principles.


In order to comply with these Data Protection Principles, it is essential that you follow the following procedures when collecting and inputting personal data about individuals:
  • Tell them that their data will be stored on the Information Platform controlled by RSA and that other users of the Information Platform (which may include employees of the RSA Group, network partners, clients and brokers) may have access to it.
  • Tell them why you need their personal data and get their consent to use it.
  • Tell them that they have the right to access the information held about them.Tell them that they have the right to access the information held about them.
  • Inform them that they have a right to request that their personal data be amended or deleted
  • Explain the consequences (if any) if they do not provide all or part of the requested personal data.
  • Explain that their personal data will not be used for direct marketing.
  • Make sure that you record personal data accurately.
  • Collect only the data you need to complete the various data fields which have to be completed.
  • Where these data fields allow you to decide what information you input:
  • only record information relevant to the business of the Global Network
  • be brief and record no more information that you think is necessary;
  • only record facts, never opinions, whether they are yours or somebody else's;
  • record nothing which you would not be happy for the person concerned to see; and
  • never include details about a person's racial or ethnic origin, health, political or religious beliefs, sex life, trade union membership or any information about any criminal offences of which they have been accused or convicted, including any punishments they have received.
Additionally, when you access or otherwise use personal data from the Information Platform, you must:
  • Only use that personal data for the job you are employed to do.
  • Never let anyone know your password or user ID and never write your password down.
  • Keep access to your files and computer secure, and log-off when you are away from your desk.
  • Treat personal data as confidential and do not reveal it to anyone except your supervisor or manager or with their permission.
  • Dispose of personal data properly and keep your desk secure.
  • Double check the fax number or address if faxing, posting or emailing personal data to anybody.
  • Never use personal data for direct marketing purposes.
The people whose personal data is held on the Information Platform are entitled to have access to it. If you are asked by any of these people for information:
  • Always check their identity – every person, every time.
  • Do not reveal any information if you are in doubt as to whether the person asking for it is entitled to it – if in doubt, don't give it out.
Refer to your supervisor or manager if:
  • You receive a complaint from anyone concerning the storage or use of personal data.
  • You are involved in or are aware of an incident involving the disclosure of personal data that breaches or may breach these Terms and Conditions of Use.
  • You receive an enquiry from the police of other official body concerning personal data.
  • You are unsure how to proceed.

You must ensure that all personal data which is held on the Information Platform is used only for the purposes for which it was obtained and in accordance with these Terms and Conditions of Use.


If you obtain, use or disclose personal data otherwise than in accordance with these Terms and Conditions of Use, you may commit an offence.


These Terms and Conditions of Use apply to all personal data which you and all other users of the Information Platform provide, collect, use or disclose and which is or will be held on the Information Platform. The individuals to whom this personal data relates may include your colleagues, people working at other organisations having access to the Information Platform (such as our network partners or brokers), their client companies, individuals involved in insurance claims and also you.


COPYRIGHT AND TRADE MARKS
All rights in the design, text, graphics and other materials on this web site and the selection and arrangement thereof are the copyright of RSA or its third party licensors. The RSA, trade marks, logos and get-up are owned by us or by other companies within the RSA Group and may not be used or reproduced by users of the Information Platform.


APPLICABLE LAW
These conditions shall be governed and construed in accordance with English Law and any disputes shall fall within the exclusive jurisdiction of the English Courts.
